I’m sure the motivations of everyone involved in this legal wrangle are honourable – Tom Phillips’ mother, who is the one wanting the information suppressed, Clark, her lawyer, the media lawyers arguing against her, the judge presiding over what is ultimately probably an exercise in futility. Maybe, if this drama runs on long enough and there is enough reputational damage to Fonterra, it might be in the business’ interest to cut the price to make the pain stop. It says: “We do not wish to imply that any of the actions we criticise in this report involved officers consciously doing the wrong thing or setting out to undermine the integrity of the organisation.
