The administration has indicated that IDEA oversight could be moved to the Department of Health and Human Services, where it was administered prior to the creation of the Department of Education. But in its zeal to make good on the campaign promise to deport millions of people, the Trump administration rescinded the rule — and now the approximately 600,000 undocumented children who attend school in the U.S. are technically fair game. The order also directed Attorney General Pam Bondi to work with state law enforcement to investigate K-12 teachers and school officials who “violate the law” by “facilitating the social transition of a minor.” This directive came after months of Trump pushing baseless lies about kids undergoing surgery during the school day without parental consent.
