The draft bill mandates the death penalty for people convicted of murder “where the act was committed with the intent to harm the state of Israel and the rebirth of the Jewish people in their homeland.” Palestinians mourn members of the Qassam Brigades, the armed wing of Hamas, in Gaza City after their bodies were retrieved from under the rubble following the ceasefire and the withdrawal of Israeli forces, which allowed rescue and recovery teams to reach the area, 24 October. The advisory opinion also states that Israel is obliged to “respect and protect all relief and medical personnel and facilities,” respect the prohibition on forcible transfer and deportation and to respect the right of Palestinians detained by Israel to receive visits by the International Committee of the Red Cross.
